TERMS & CONDITIONS

IN PLACING A BOOKING FOR A PUBLIC TRAINING COURSE WITH US YOU AGREE TO ACCEPT THE TERMS AND CONDITIONS BELOW:

1 DEFINITIONS AND INTERPRETATION

1.1 “Agreement” means these terms and conditions and the Order.
1.2 “Customer” means the individual or company submitting an Order to CONIM Cert.
1.3 “Course” means classroom training delivered live either physically in person or virtually via the internet.
1.4 “Online Training” means prerecorded training delivered virtually e.g. CONIM Cert e-learning.
1.5 “Order” means either the CONIM Cert training order form; or the shopping cart via the CONIM Cert website shop; or an email; which the Customer submits to CONIM Cert to procure the Training Event.
1.6 “CONIM Cert” means the “CONIM Cert” LLC, a business that offers private, accredited qualifications and tuition in management systems and ISO standards, to which the Customer submits an Order.
1.7 “Training Event” means either a Course or Online Training, or both.
1.8 Headings are for convenience only and shall not affect the interpretation of this Agreement.
1.9 All obligations of either party which comprise more than one person or entity shall be joint and several.
1.10 The use of the neuter singular gender throughout this Agreement shall include all genders and the plural.

2 ORDER PLACEMENT

2.1 Places are limited and delegates will be registered in strict order on a first-come, first-served basis. Registration is when you make a payment of course fee to secure your place in the class for the training event.
2.2 Once the course fee has been paid, within 3 business days CONIM Cert will sent confirmation notice via email, securing the learners space in the class.
2.3 Any online order for Training Event published in the website implies that the customer accepts the course content as described in the current training course catalog or published in the website.
2.4 CONIM Cert reserves the right to amend the content of any Training Event without notice to Customer to correct errors or where, at the sole discretion of CONIM Cert, such amendment is deemed not to fundamentally change the content of such Training Event.

3 PREREQUISITES / CUSTOMER RESPONSIBILITIES

3.1 An application is done so that the institution can confirm that you meet the entrance requirements for the stipulated course.
3.2 CONIM Cert reserves the right to exclude a participant from attending any Course due to disorderly conduct, failure to observe any of CONIM Cert’s rules of participation or failure to attend the prerequisite class or classes for a particular Course. No refund of fees shall be paid to Customer in such circumstances.
3.3 Customer shall ensure that all course participants fulfil any and all of the course prerequisites as communicated by CONIM Cert. CONIM Cert reserves the right to exclude any participant who does not fulfil such prerequisites. No refund of fees shall be paid to Customer in such circumstances.
3.4 If special physical access is required for people with disabilities during the Course, please notify CONIM Cert at least fourteen (14) calendar days in advance of the Course in order to allow CONIM Cert to assess the requirements.
3.5 All CONIM Cert facilities are non-smoking environments. Designated smoking areas are provided. If non-smoking restrictions are violated, the offending participant may be excluded from attending the Course. No refund of fees shall be paid to Customer in such circumstance.

4 PRICE AND PAYMENT

4.1 All standard training event fees published in the website are on a per student basis. For Courses, these fees include the price for instruction, training documentation, study materials and (for in person classroom training) refreshments.
4.2 CONIM Cert offers several payment options. The payment method must be established at the time of Order for Training or at the time of registration for Courses.
4.3 If Customer is using a purchase order as the payment method, CONIM Cert requires the purchase order number at the time of Order for Training or at the time of registration or scheduling for Courses. For Courses, hard copies of the purchase order should be mailed to CONIM Cert to arrive no later than 20 calendar days before the start date of Course.
4.4 All fees are quoted inclusive of VAT, which will be charged at the prevailing rate.
4.5 Course participants must make their own arrangements for accommodations. Any use of hotel services including, without limitation, their shuttle bus or other transportation is at the discretion of the Customer and solely a relationship between the Customer and the hotel or transportation provider. In no event, including where Courses are cancelled, will CONIM Cert be liable for any accommodation costs.

5 CANCELLATION AND REFUND

5.1 All cancellations must be confirmed in writing. Cancellations received in writing less than 30 days but more than 15 days before course start date will receive a refund of 50% of course fees. Any cancellation received less than 15 days prior to course start date shall not receive a refund.
5.2 Customer may request a transfer to a later training event up to 15 days before the course start date, subject to the following: if the request prevents a course from running, or should additional costs be incurred by CONIM Cert, then these will re-charged to the delegate, to a maximum of the full course fee. Any transfer request received less than 15 days prior to the course start date shall not receive a refund. Only one transfer request per booking allowed.
5.3 CONIM Cert reserves the right, at its discretion, to cancel or postpone courses at any time. If a course is cancelled and an alternative date is not suitable, fees will be refunded in full. CONIM Cert will not be liable for any expenses incurred by delegates other than the course fee paid.
5.4 If customer needs to organize transport to the venue that may incur any costs directly to him/her, it should be check with the CONIM Cert office before making any booking to ensure that the course is running, as CONIM Cert cannot be held liable for any expenses incurred.
5.5 CONIM Cert will confirm all cancellations or rescheduling requests by e-mail. Financial responsibility remains with the Customer for all fees unless a proper cancellation or rescheduling request is received and confirmed by CONIM Cert prior to the start of the Course.
5.6 Feedback on CONIM Cert courses is very important to CONIM Cert. In the unlikely event a participant is extremely dissatisfied with a course, please provide CONIM Cert with written notice (in a form other than the post-course survey) of any details regarding such dissatisfaction, within thirty (30) calendar days of completion of the applicable course. Please address correspondence to the CONIM Cert email address found in the contact section of conimcert.com. After receiving such notice, CONIM Cert may, in its sole discretion, determine if any remedy (such as a credit) is appropriate. CONIM Cert will not consider a possible remedy if such notice is not received within the thirty (30) calendar days set forth above.

6 CERTIFICATES

6.1 Certificates are issued for certain courses, please see specific courses for details.
6.2 Results of training courses and certificates of attendance/completion will not be released until full payment is received.

7 DATA PROTECTION AND PRIVACY

7.1 We are committed to protecting the privacy of anyone using our site and the confidentiality of any information that you provide us with. We endeavor to take all reasonable steps to protect your personal information However, we cannot guarantee the security of any data that you disclose online and we will not be responsible for any breach of security unless this is due to our negligence or willful default.
7.2 In general you can visit our website without telling us who you are and without revealing any information about yourself. However, there are areas of our website where we do gather data as follows:
7.2.1 If you submit an enquiry via our website you will be asked to provide certain information, including name, e-mail address and contact number.
7.2.2 If you register on our website to receive newsletters from us you will be asked to provide your name and e-mail address.
7.2.3 If you purchase items via our website you will be asked to register and provide information including name, address, business name, e-mail, telephone number and payment details.
7.3 Any information utilized for payment or accounting purposes is held by a third party secure site. We do not actively source any personal data from publicly available sources and/or from third party data vendors. However, if this does occur, we will ask for your consent to retain such information as maybe necessary to better serve you.
7.4 Any external links that you may visit from our website is not our responsibility. Once you click on a link to an external site it will be subject to that organization’s privacy policies, and not ours.
7.5 You have the right to see personal data (as defined in GDPR) that we keep about you upon receipt of a written request.
7.6 In the event that you wish to complain about how we have handled your personal data, you may make a formal complaint in writing and we will look in to your complaint and work with you to resolve the matter.

8 INTELLECTUAL PROPERTY RIGHTS

8.1 The copyright in and all other intellectual property rights relating to the Course and the Course documentation provided to Customer are solely owned by and hereby reserved to CONIM Cert. Under no circumstances may the whole or any part of the Course or Course documentation be produced or copied in any form or by any means or translated into another language without the prior written permission of CONIM Cert.

9 WARRANTIES AND LIABILITY

9.1 Whilst every effort is made by CONIM Cert to ensure that the Training Event instructors are appropriately qualified and trained, CONIM Cert does not accept liability for any loss, cost or expense or for any special or indirect or consequential damages arising from negligence, misconduct or lack of skill in delivering the Training Event.
9.2 CONIM Cert shall not be liable for damages of any kind including without limitation direct, special, indirect, or consequential damages, including loss of profit or other financial loss that may result from Training Events (including, without limitation, resulting from the performance or cancellation of Training Events). In no event shall CONIM Cert’s liability to customer or any other party exceed, in the aggregate, the fees paid for the use of the Training Event from which the damages arise. Where CONIM Cert’s liability is excluded or limited, this also applies to the personal liability of CONIM Cert’s employees, representatives, and people performing duties on CONIM Cert’s behalf.
9.3 CONIM Cert does not warrant the accuracy or completeness of Training Events, nor any links or the information, text, graphics, links, or other items contained within Training Events. CONIM Cert and its licensors disclaim all warranties express or implied, including without limitation, any implied warranties of merchantability or fitness for a particular purpose except to the extent that any warranties implied by law cannot be validly waived.
9.4 CONIM Cert assumes no responsibility for errors or omissions in the Training Events. It is the Customer’s duty to verify such information.

10 FORCE MAJEURE

10.1 Any delay or nonperformance of any provision of this Agreement (other than for the payment of amounts due here under) caused by conditions beyond the reasonable control of the performing party shall not constitute a breach of this Agreement, and the time for performance of such provision, if any, shall be deemed to be extended for a period equal to the duration of the conditions preventing performance.

11 GOVERNING LAW

11.1 This Agreement and any claims arising out of or relating to this Agreement and its subject matter shall be governed by and construed under the laws of Republic of Azerbaijan.
